Outsourcing Legal Entities

At a certain stage of its development, each company faces a number of challenges requiring the engagement of a qualified lawyer. Legal counsel ' s consultations may be necessary at any time in the organization ' s activities, ranging from pre-contract negotiations to enforcement of a court decision.
At this point, two solutions to the problem arise before the manager:
- hiring a full-time lawyer
- Seek qualified assistance from the legal aid organization.
Pros and cons of a full-time lawyer
Firms require highly skilled professionals, who in turn count on prestigious posts and high wages. Not all organizations are willing to spend most of their budget on such staff. In order to save money and not to break up with years of work (the legalist of the enterprise), the company may attract new recruits or professionals with no high ambition in its work.
The hiring of a professional lawyer in the company is costly enough.
- A lawyer should be provided with a well-equipped workplace, the necessary literature and access to reference information systems;
- It is necessary to ensure the growth and development of a lawyer, as a specialist, to pay for refresher courses, to attend seminars and professional training;
- Provision of social guarantees in accordance with the Labour Codes of the Russian Federation (hospital, leave);
- A full-time specialist may suffer, leave or resign, which will not result in the completion of the work on time;
- There is a risk of a lawyer leaving for a competing firm, thus confidentiality at the official level may be compromised;
- The untrained person, without a deep knowledge of the relevant branches of law, having hired a lawyer, is difficult to assess the quality of his work,
- There is a risk that a lawyer would prefer a different place of work that would be more appropriate for his career to gain the necessary experience in the firm.
Not all firms can afford to maintain their own legal profession sufficient to deal with emerging skill issues, in such cases it will be prudent to seek assistance from specialized legal aid companies.
